terms & conditions

(aka "the important stuff")

  • § 1. General provisions

    1. These Terms and Conditions shall determine conditions, rules and scope of use by natural persons, legal persons and organizational units who are granted legal capacity by the law of internet platform dodowork available at https://app.dodo.work that enables connecting Freelancers into Project teams adjusted to the Project/Employer requirements. Connection is executed on the basis of information provided by the Freelancers regarding their qualifications, abilities, experience and psychometric data. Use of the Internet platform is possible only on terms constituted by the following Terms and Conditions and in accordance with generally applicable laws.

    2. The following Terms and Conditions are regulations within the meaning of Article 8 of the Act of 18 July 2002 on Providing Services by Electronic Means. (Polish Journal of Laws of 2020, item 344 as amended)

    3. Service Provider who provides services by electronic means through Internet platform dodowork is Dodowork Sp. z o.o. with its registered seat in Stalowa Wola, 37-450, Kwiatkowskiego 9 entered into the register of entrepreneurs maintained by District Court in Rzeszów, 12th Department of the National Court Register under the KRS Number: 0000838562, NIP (Taxpayer Identification Number): 8652573507, REGON (National Official Business Register): 385941879, e-mail address: do@dodo.work, website: https://dodo.work.

    4. Service Provider is also the owner and operator of the Internet platform.

    5. Terms and Conditions are free of charge and available online publicly at the following website: https://dodo.work/tos. Terms and Conditions enable the acquisition, playback and recording of its content by means of an ICT system used by the User.

    6. User acknowledges that providing Services using Internet platform takes place through ITC system which ensures processing and storage, as well as sending and receiving data through telecommunications networks, in accordance with the Act on Providing Services by Electronic Means.

    7. In matters not regulated herein, the applicable laws shall apply, including in particular the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws of 2020, item 344, as amended), Act of 23 April 1964, Civil Code (Journal of Laws of 2019, item 1145, as amended), Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2020, item 287, as amended).

  • § 2. Definitions

    1. Unless provided otherwise, the following expressions should be understood as indicated it these Terms and Conditions.

    a) Personal Data – personal data within the meaning of Article 4 item 1 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

    b) Service – provided on the basis of the Terms and Conditions, for the benefit of the User, a service constituting an electronic service within the meaning of the Act on the Providing Services by Electronic Means.

    c) User – entity concluding an agreement with the Service Provider for the use of the Service, having the right to use the Services offered through the Internet platform.

    d) Freelancer – User, who is a natural person or a natural person conducting a business activity registered on dodowork platform as a Freelancer.

    e) Employer – User, who is a natural person, a legal person or an organizational unit without legal personality registered on dodowork platform as Employer.

    f) Project –enterprise added by the Employer to be executed by Freelancers that will be conducted on the basis of cooperation, regardless of the legal basis of the cooperation. Legal basis of the cooperation can constitute: employment contract, mandate agreement, contract for specific work, civil law contract.

  • § 3. Services

    1. Service Provider provides its services by electronic means through Internet platform for Users, including:

    a) Freelancer registration;

    b) Freelancer verification;

    c) Employer registration;

    d) Employer verification;

    e) Adding Project;

    f) Gathering a Project Team;

    g) Project execution assessment.

  • § 4. Technical requirements necessary to use the Services

    1. Users can use the Internet platform at: https://app.dodo.work.

    2. Costs of data transmission required to launch and use the Internet platform are covered at the Users’ own expense on the basis of their agreements concluded with telecommunication operators and other internet service providers. User holds liability for covering all data transmission payments necessary to use the Internet platform.

    3. Internet platform and all included materials, information, layout of the content, logos, graphics and trademarks constitute property of Service Provider and are protected by law.   

    4. Internet platform is accessible for the Users using fixed and mobile devices with the newest version of the browser (recommended browsers are: Chrome, Firefox, Opera, Safari)

    5. Active internet connection is necessary to launch and ensure proper functioning of the platform.

    6. User has to complete registration via the Internet platform to be able to fully use it.

  • § 5. Use of the Internet platform

    1. Commencement of using the Internet platform by the User is tantamount to the following statements:

    a) I have read Terms and Conditions and I accept its statements,

    b) I am joining the service voluntarily,

    c) data provided at the commencement of using the Services are true,

    d) I agree to the processing of my personal data by the Service Provider for the purposes related to ensuring proper functioning of the Services,

    e) I agree to obtaining system information and messages from the Service Provider.

    2. User shall use the internet platform according to the Terms and Conditions, applicable legislation and general rules of Internet use. User is particularly obliged to use the platform in a manner that does not infringe the rights of third parties, rights and interests of the Service Provider and other Users.

    3. It is forbidden to use the platform in a manner that is inappropriate and contrary to its purpose. In particular, it is prohibited for the Users to use the platform in a manner contrary to the Terms and Conditions, common laws or good practice.

    4. User shall be fully responsible for all content published by the User.

    5. Users shall complete the registration process in the platform consisting of creating individual account in order to use the services provided by the Internet platform.

    6. Launching and logging to the Internet platform is necessary to use the Internet platform.

  • § 6. Freelancer Registration Service

    1. Freelancer registers on a dodowork platform by using „Freelancer Registration” functionality.

    2. In order to complete registration, Freelancer shall provide the following data:

    a) e-mail address,

    b) category/sector of services offered by the Freelancer,

    c) full name,

    d) years of experience (from 0.5 to 50 years),

    e) abilities and tools used by the Freelancer during work (indicating the experience level),

    f) profile photo,

    g) optionally, a link to an introductory video presenting the Freelancer – in order to increase the profile attractiveness,

    h) job position of the Freelancer,

    i) description of the Freelancer,

    j) time zone in which the Freelancer works,

    k) standard working hours of the Freelancer (any period between 0:00 AM and 11:00 PM),

    l) languages used by the Freelancer, indicating the language level;

    m) links to portfolios, past work, LinkedIn account or other websites indicating experience, profile or works of the Freelancer (it is obligatory to submit at least one link),

    n) optionally: experience (date, position, company name, scope of duties),

    o) hourly rate for the services provided by the Freelancer,

    p) information whether the Freelancer issues invoices to the clients.

    3. After filling the information by the Freelancer, it is sent to be verified by the Service Provider.

    4. After completing registration, the Freelancer is given access to full functionality of the platform, such as availability calendar, where the Freelancer can mark availability or holiday – full day (8 hours) or half a day (4 hours).

    5. After completing registration, the Freelancer is given access to full functionality of the platform, such as inviting friends to the dodowork platform. For this purpose, Freelancer has to provide full name and e-mail address of the acquaintance. As a part of the functionality of inviting friends, the Freelancer can also determine whether he or she wants to work with the invited acquaintance on Projects on the dodowork platform

    5. Freelancer is entitled to edit his or her data provided during the registration and to change the password set up during the registration. Data editing and password change is possible via Internet platform. All editions of the data by the Freelancer mentioned in the paragraph 2 above require verification by the Service Provider.

    7. During registration and while using the Internet platform the Freelancer shall:

    a) provide true, precise and up-to-date and not misleading data;

    b) update data provided during registration in case of any necessary changes;

    c) not disclose login password to the Internet platform and not share it with third parties.

    8. Freelancer is solely responsible for the incompliance of provided data, as well as disclosure of the password to third parties.

  • § 7. Freelancer Verification Service

    1. Data provided by the Freelancer during the registration mentioned in § 6. paragraph 2 are subject to verification by the Service Provider.

    2. The Freelancer Verification Service includes:

    a) screening of the Freelancer’s profile and provided data,

    b) contact of the Freelancer with the Service Provider.

    3. Contact between the Service Provider and the Freelancer will take place through videoconference via such platforms as Zoom or Google Meet

    4. Purpose of contacting the Service Provider includes verifying whether the Freelancer’s data regarding his abilities and experience are true and verifying language and communication skills.

    5. During the meeting, Service Provider may give the Freelancer a short task related to the Freelancer’s field of expertise.

    6. After a positive verification of the Freelancer, the Service Provider sends to a Freelancer a link to the psychometric test to determine psychometric profile of the Freelancer. Its purpose is to match the Freelancer with adequate Employer’s projects and other Freelancers.

  • § 8. Employer Registration Service

    1. Employer registers on a dodowork platform by using „Employer Registration” functionality.

    2. In order to complete registration, the Employer shall provide the following data:

    a) e-mail address,

    b) information whether the Employer is a natural person, legal person or an organizational unit without legal personality,

    c) Employer’s name,

    d) photo or logo (optional),

    e) address (optional),

    f) industry sector in which the Employer offers a job,

    g) company size,

    h) links to websites and social media (optional),

    i) description of company’s business activity (optional),

    j) abilities and tools used in the Employer’s company/team placed on 3 frequency levels: always, often, sometimes (optional),

    k) time zone in which the Employer offers a job,

    l) standard hours during which work is normally performed for the Employer (timeframe)

    m) languages in which the Employer offers a job (it is possible to choose any number of languages)

    3. Employer is entitled to edit his or her data provided during the registration and to change the password set up during the registration. Data edition is possible via the Internet platform.

    4. During the registration and while using the Internet platform the Employer shall:

    a) provide true, precise and up-to-date and not misleading data;

    b) update data provided during registration in case of any necessary changes;

    c) not disclose login password to the Internet platform and not share it with third parties.

    5. Employer is solely responsible for the incompliance of provided data, as well as disclosure of the password to third parties.

  • § 9. Employer Verification Service

    1. Data provided by the Employer during the registration mentioned in § 8. paragraph 2 are subject to verification by the Service Provider.

    2. Employer verification service includes screening of the Employer’s profile and provided data.

    3. After a positive verification by the Service Provider, the Employer obtains full access to all of the platform’s functionalities.

  • § 10. Adding a New Project Service

    1. As a part of functionalities of the dodowork platform the Employer is given the possibility to add a Project to the platform, in which the Freelancers are to be involved. This is possible through the functionality „Adding a Project”

    2. To add a Project, it is necessary to provide the following data regarding the Project:

    a) Project name;

    b) Project description;

    c) category of expertise (e.g. Design, Software development – it is possible to choose many categories of expertise),

    d) key tools and abilities located on two levels “MUST HAVE” and “NICE TO HAVE”,

    e) the maximum Project budget,

    f) Project completion time (deadline to choose from the list),

    g) the date by which the Project must be completed (date to choose from the calendar),

    h) the information whether the Employer needs the Freelancer to work in the similar time zone as the Employer and if so, how many Employer’s and Freelancer’s working hours daily must overlap,

    i) information whether Freelancer/Freelancers will work as a part of the Employer’s team during the realization of the Project and if so, how many people will cooperate during implementation of the Project (range 1-9 people).

  • § 11. Gathering a Project Team Service

    1. After adding a New Project by the Employer, referred to in § 10 paragraph 2, Project is due to verification and the process of gathering the Project team starts.

    2. Gathering a Project team is the Service Provider’s task completed based on the data provided by the Freelancers and Employers during the registration process and on the results of psychometric tests filled by the Freelancers.

    3. After choosing the Freelancers to the Project, selected Freelancer’s data is sent to the Employer’s account created on the platform for approval. Then, the Project details are sent to the Freelancers also for approval.

    4. After accepting the Freelancers to be a part of the project team, the Project, within the functionality of the platform, goes to the “in progress” tab, and after its completion to the “completed” tab.

    5. In case of lack of acceptance from the Employer regarding the Freelancer or Project by the Freelancer, Service Provider sends to the Employer another proposal of the Project team till obtaining approval of the team and the Project by the Employer and by all the Freelancers.

    6. Conducting and managing the Project takes places outside the dodowork platform. Service Provider does not hold responsibility for the quality of the services provided by the Freelancers to the Employer nor for the results of their work and any possible damage caused during implementation of the Project.

    7. Service Provider shall not be responsible for any claims arising from the relationship between Freelancer and the Employer in connection with the Project.

  • § 12. Project Execution Assessment

    1. After completing the Project, Service Provider sends to the Employer and each one of the Freelancers participating in the Project a request for assessment. This assessment is obligatory.

    2. Employer assesses:
    a) satisfaction with the Project,

    b) satisfaction with the platform,

    c) satisfaction with the team,

    d) optionally, the Employer can enter his own additional remarks regarding completion of the Project.

    3. Freelancer taking part in the Project assesses:

    a)   satisfaction with the Project,

    b) interest in working with similar Projects in the future,

    c) interest in working with the same Employer in the future,

    d) interest in working with the same Project team in the future,

    e) interest in working with the individual participants on the Project team in the future.

    4. Freelancer that obtains positive assessment from the Service Provider, as well as Employers and other Freelancers after completing at least 3 Projects, is given the status of Premium Dodo and will have the possibility to verify new Users  – Freelancers.

    5. For verifying new Users – Freelancers, Premium Dodo will receive remuneration in the amount of 2% of the earnings gained through the platform by the verified Freelancer. Remuneration shall be paid by the Service Provider each time up to 7 days from the moment of remunerating the Freelancer verified by Premium Dodo.

    6. Premium Dodo as a part of the assessment of the new Users – Freelancers is obliged to conduct an interview with the Freelancer and to assess his or her ability levels in the fields the Freelancer provided during the registration as well as his or her language (English) and communication skills.

    7. Premium Dodo can verify new Users – Freelancers only when declared expertise category or at least some of the declared competences of Premium Dodo and Freelancer overlap.

    8. Based on the activities performed by Premium Dodo referred to in paragraph 6, the Service Provider evaluates whether the new Freelancer is to be included into the dodowork platform.

    9. Premium Dodo can recommend only 1 new person per week to be added to the dodowork platform, regardless of the number of verifications performed in a given week.

    10. Service Provider shall evaluate the verification abilities of Premium Dodo based on the assessment of the User – Freelancer after completing the Project via dodowork platform. If the assessments are unsatisfactory (more than 20% unsatisfied Employers), the Service Provider can decide that Premium Dodo will no longer have the possibility to verify new Freelancers.

  • § 13. Fees

    1. Service Provider shall not charge the User for account registration, creating and verification of the profile or adding a new project.

    2. After accepting the Project team suggested by the Service Provider, the User – Employer is obliged to pay in advance for the whole project or for milestone agreed with the Service Provider that constitutes part of the project. Payment is based on the estimated duration of the project or milestone and on hourly rates of Freelancers participating in the Project.

    3. Employer can complete the payment through the external payment system Stripe after clicking the link sent by e-mail by the Service Provider.

    4. After completing the Project or each milestone, Employer confirms the correctness of the service provision which is tantamount to paying the appropriate fee charged based on the hours spent on the project or the milestone and hourly rates of the Freelancer. Payment is sent to each one of the Freelancers taking part in the project through the external payment system Stripe.

    5. Condition for receiving remuneration for participation in the project by the Freelancer is completing all the data required in the Stripe payment system after clicking the link sent via e-mail by the Service Provider.

    6. Freelancer is solely responsible for the accuracy of the data provided during the payment process. Freelancer shall provide fundamental and up-to-date data for identification purposes. In case of non-delivery or delivery of incorrect data, the Service Provider reserves the right to withhold the payment until providing correct data.

    7. Service of adjusting the Freelancers to the Projects provided by the Service Provider through the platform is chargeable. All fees and commissions are charged to the Freelancer.

    8. As of 15 September 2020, the fee for the above service is 10% of the remuneration of the Freelancer calculated from the total remuneration, after deduction of fees related to the payment processing by the external payment system Stripe. Fee is charged automatically. User agrees to that by accepting the Terms and Conditions during the registration.

  • § 14. Technical support and the quality of the Services provided via Internet platform

    1. Service Provider shall provide the User any needed help in managing and technical issues related with the Service. All problems in this matter should be reported via e-mail to do@dodo.work.

    2. Service Provider is responsible for the proper functioning of the Internet platform and services that are provided through the platform.

    3. To maintain the correct functioning of the Internet platform and provided services, the Service Provider is entitled to conduct periodical maintenance processes that can result in access interruptions to the provided services.

    4. Service Provider shall not be responsible for the damages caused by interrupted Internet accessibility nor interruptions related to maintenance referred to in paragraph 3 above.

  • § 15. Complaint procedure

    1. To submit a complaint due to non-performance or improper performance of the Service by the Internet platform, the complaint should be sent to e-mail address do@dodo.work indicating:

    a) data of the person submitting a complaint – first name, last name, correspondence address, User login,

    b) short description of the claims,

    c) User’s proposal of how the reported infringements should be removed.

    2. In case of submitting a complaint without the above-mentioned elements, the User will be asked to complete them. Complaint shall be considered within 14 days from the moment of proper reporting and will result in the indication whether the complaint is valid and justification of Service Provider’s position.

  • § 16. Personal data protection

    1. Service Provider shall be the personal data controller.

    2. Personal Data is provided by the User while filling the registration form.

    3. Providing personal data each time causes the entity indicated in paragraph 1 to become their Data Controller.

    4. Basis for Personal Data processing shall be consent, if applicable, to the relevant law, or that the processing is necessary for the performance of the agreement or for taking action, before concluding the agreement.

    5. Personal data is processed by the Service Provider in order to guarantee the proper functioning and use of the Internet platform, use of the services provided via platform and compliance with the law, completion of the agreements concluded between Service Provider and the User, promotional and marketing activities.

    6. In order to achieve the goals referred to in paragraph 5 the following User’s data is collected: full name, telephone number, e-mail address.

    7. Service Provider processes the data regarding the User, including personal data in accordance with the applicable laws, in particular with General Data Protection Regulation, Act on Providing Services by Electronic Means, using legally required safeguards and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

    8. At all times, User is entitled to the access to his or her personal data. It is possible to contact the Personal Data Controller to request information on whether certain Personal Data is being processed, to provide access to it, and to receive other information.

    9. User is entitled to erase personal data using „right to be forgotten” in cases foreseen by generally applicable law.

  • § 17. Parties’ responsibilities, termination of the Internet platform use

    1. Service Provider is not responsible for the damages caused by interrupted Internet access or interruptions in providing services due to failure of third parties to perform their obligations, random events or events of force majeure.

    2. Service Provider shall not hold liability for the benefits lost by the User and for damages caused by the lack of continuity of the Service for reasons attributable to the User caused by misusing the Internet platform incompliant with its intended use and functionalities. Service Provider does not hold responsibility for the losses incurred by the User that were caused by Internet risks beyond Service Provider’s control.

    3. Service Provider does not hold responsibility for the User’s personal data loss or in the event of force majeure or illegal action by third parties.

    4. User is fully responsible for misusing the platform and its functionalities as well as for the actions and omissions incompliant with these Terms and Conditions and generally applicable laws.

    5. Both the User and the Service Provider have the right to terminate the agreement on providing services by electronic means with 30 days’ notice effective at the end of a calendar month

    6. Termination notice can be delivered in writing or by e-mail address do@dodo.work and is effective with the moment of its delivery to the other party. After the notice period, Service Provider will remove the User’s account.

  • § 18. Final provisions

    1. These Terms and Conditions can be modified by the Service Provider at any time.

    2. Promptly after introducing changes to the Terms and Conditions, it shall be updated in the places where it was made available.

    3. Service Provider shall duly notify the Users about modifications herein.

    4. Service Provider shall have the right to modify the content of the provided Service at any time.

    5. Detailed issues concerning mutual rights and obligations between the Service Provider and Freelancer and between the Service Provider and the Employer are determined by separate Agreements concerning the availability of the Services provided through the Internet platform. These Terms and Conditions constitute an integral part of these Agreements.

    6. Terms and Conditions shall enter into force on 15 September 2020.
